Tixato Privacy Policy

The privacy of your information and your patrons’ information is very important to Figure 53. We designed Tixato to help theaters manage and use information about their performances, their box offices, and their patrons. That said, it is important that we be responsible stewards of that information. To that end, we have created this Privacy Policy to govern the use of the Tixato Service and the Tixato website.

This Privacy Policy discloses our information gathering and disseminating practices for the website, Tixato.com (the “Tixato Website”), and for the Tixato box office management service (“Tixato” or the “Tixato Service”). In this Privacy Policy, “we” or “us” means Figure 53, LLC, its service providers, and any successors in interest.

Notice

We reserve the right to change this Privacy Policy from time to time, as necessary and as our service develops. The most current Privacy Policy will be available at tixato.com/legal/privacy. Material changes to this Privacy Policy will be announced on the Tixato website, and will be emailed to registered Users. Your continued use of the Tixato Service or the Tixato Website constitutes acceptance of this Privacy Policy.

Please be aware that if you click on any links that take you to other sites, the privacy policies and terms of use of those other sites will apply, and not this Privacy Policy.

The Who, What and How of Information Collection

We collect and use different information from different people, based on their relationship to the Tixato Service and the Tixato Website. Keep in mind that these categories are not mutually exclusive – you may be a Visitor and an Admin, or a Patron of one Organization and a User for another. You may be all of these.

Visitors.

A “Visitor” is anyone who visits the Tixato website or any other page hosted at Tixato.com. We collect standard analytics information about visitors to the Tixato Website. This information may include IP address, referring site, pages visited, date and time of the visit, and how long a Visitor viewed any given page. This information is used to help improve the Tixato Website and for other internal purposes. This information is not sold to any third parties. We may provide third parties with aggregate information regarding Visitors to the Tixato Website. This aggregate information will contain nothing that can identify you, and will not contain any personally identifiable information that refers or relates to you.

If a Visitor to the Tixato website purchases a ticket through the Tixato online purchase form, we will collect information from the Visitor, including name and credit card information. This information is treated as Patron information, as explained below.

Users.

“User” is a Visitor to the Tixato site or a user of the Tixato Service, who has a Tixato account and login. We collect information from Users during the registration process, including User’s name and Organization affiliation. We also collect analytics information about User’s use of the Tixato Website and the Tixato Service, similar to the information collected about Visitors. Some information collected about Users, such as name and email, will be shared with the User’s Organizations, and that Organization’s Admin. Information collected from and about Users may also be used by us to improve the Tixato Website and the Tixato Service. We will also collect any information Users provide to us in an email or support request. This information will not be sold to third parties. We may provide third parties with aggregate information regarding Users of the Tixato Service. This aggregate information will contain nothing that can identify you, and will not contain any personally identifiable information that refers or relates to you.

Admins.

“Admin” is a User who has responsibility and control over at least one Organization Account, and over the Users associated with the Organization Account. An Admin has the ability to modify their Organization’s Account, and to add or delete Users from that Organization Account. We may collect information from Admins during the registration process, including their name, their Organization, their email address, their mailing address, and their phone number. We also collect analytics information about Admins’ use of the Tixato Website and the Tixato Service, similar to the information collected about Users. We will also collect any information Admins provide to us in an email or support request. Information collected from and about Admins may also be used by us to improve the Tixato Website and the Tixato Service. Information about Admins will not be sold to third parties.

Patrons.

A Patron is a customer of an Organization. Organizations may collect information from Patrons through Tixato's online ticket sales or otherwise, and may use the Tixato Service to store, manage and use that information, which may include the Patron’s name, email address, phone number and mailing address. We may access Patron Data from time to time for the purpose of maintaining and improving the Tixato Service. Patron Data will not be sold to third parties. Organizations and Admins are responsible for ensuring that they have permission to use their Patron Data, and that their collection and use of Patron Data is in accordance with their local laws.

Some Organizations process Patron credit cards through Tixato when a Patron purchases a ticket either in person on through Tixato online ticket sales. When purchasing a ticket in person, Patrons may give their credit card information to an Organization for the purpose of making a purchase. Organizations are not permitted to store Patron credit card numbers in Tixato, except by submitting it into a secure form. Organizations never see Patron credit card information for purchases made through Tixato’s online ticket sales. Credit card numbers entered into the secure form in the Tixato box-office system or Tixato's online ticket sales are encrypted and sent to a third party credit card clearinghouse for processing. Patron credit card numbers may be seen by the Organization during an in-person purchase, and are seen by the third party clearinghouse during processing. We have no ability to access Patron credit card numbers properly entered by Organizations into Tixato’s secure credit card purchase form.

Security of Your Information

We take the security of your information very seriously. The Tixato Service runs on servers that are in a secured physical and network environment. Reasonable efforts are made to secure web servers, networks, host operating systems and databases against unauthorized access. Please remember that the security measures taken above are not foolproof; no website can guarantee that personally identifiable information will be protected in all situations. Therefore we can only state that we will make a reasonable effort to protect from unauthorized access the information that you provide, and that if we are notified of a breach, we will comply with applicable law. However, unless a statute provides you a right that cannot be waived, you specifically waive and covenant not to sue us for any data loss or breach of our system resulting in loss of personal information.

Sharing Required by Law

We will share your information in response to a valid court order or legal process served on us. We may also share your information, or Patron information if we feel that disclosure is necessary to defend our rights.

Transfer to a Successor in Interest

Notwithstanding the above, in the case where We merge, sell our business, or otherwise transfer operational control of our business to a new owner, whether we do so directly or indirectly, you hereby authorize us to transfer your entire personal information to such purchaser, so long as such purchaser agrees to abide by the terms of this Privacy Policy.


Other legal documents
